Please read these Terms of Service (“Terms”) carefully before using any Prometheuz website, application, or telehealth service (collectively, the “Services”). These Terms constitute a legally binding agreement between you and Prometheuz. By accessing or using the Services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them.
1. Acceptance of Terms
By creating an account, accessing any portion of the Services, or clicking “I Agree” or a similar button, you accept and agree to these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Services. We reserve the right to modify these Terms at any time. Continued use of the Services after any modification constitutes acceptance of the updated Terms.
2. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates applicable federal, state, local, or international law or regulation.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Submit false, inaccurate, or misleading health or personal information.
- Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services.
- Transmit any unsolicited or unauthorized advertising or promotional material.
- Use the Services to harm, harass, or intimidate any individual, including Prometheuz staff or providers.
- Reverse-engineer, decompile, or disassemble any software component of the Services.
We reserve the right to terminate or suspend your access to the Services for violation of these Terms, at our sole discretion and without prior notice.
3. Medical Disclaimer
Prometheuz is a telehealth platform that connects patients with independently licensed healthcare providers. Prometheuz itself is not a medical provider and does not practice medicine.
The content available through the Services — including articles, FAQs, and educational materials — is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition.
In a medical emergency, call 911 or your local emergency number immediately. Do not rely on the Services for emergency medical care. The Services are not designed or intended for emergencies.
The provider-patient relationship is solely between you and the licensed provider you consult through our platform. Prometheuz does not employ providers, endorse any specific provider, or guarantee the accuracy or appropriateness of any clinical advice provided.
4. Subscription & Payment
Certain features of the Services require a paid subscription (“Subscription”). By purchasing a Subscription, you authorize Prometheuz or its payment processor to charge your payment method on a recurring basis at the rate disclosed at time of purchase, until you cancel.
- Billing: Subscriptions are billed in advance on a monthly or other periodic cycle. Charges are non-refundable except as described in our Cancellation & Refund Policy.
- Price changes: We may change Subscription pricing at any time. We will provide at least 30 days’ notice before any price increase takes effect for existing subscribers.
- Cancellation: You may cancel at any time by contacting [email protected] at least 72 hours before your next billing date. See our Cancellation & Refund Policy for details.
- Failed payments: If your payment fails, we may suspend your access to the Services until payment is received.
5. Intellectual Property
The Services and all content, features, and functionality — including but not limited to text, graphics, logos, icons, images, audio, video, software, and the selection and arrangement thereof — are owned by or licensed to Prometheuz and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Services without our prior written consent.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Prometheuz and its officers, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including, without limitation, loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, the Services, even if Prometheuz has been advised of the possibility of such damages.
Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the total amount you paid to Prometheuz in the 12 months prior to the event giving rise to the claim, or (b) one hundred dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Governing Law
These Terms and any dispute arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes not subject to arbitration.
You and Prometheuz agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved by binding individual arbitration, except that either party may bring claims in small claims court if they qualify. You waive the right to participate in a class action lawsuit or class-wide arbitration.
8. Changes to Terms
We may revise these Terms at any time by posting an updated version on our website. We will provide advance notice of material changes by email or through a prominent in-app notice. Your continued use of the Services after the effective date of any revision constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Services.
9. Partner Pharmacies
Prometheuz partners with the following licensed compounding pharmacies to fulfill prescription medications ordered through the Services. Patients should not contact pharmacies directly regarding prescriptions placed through Prometheuz — all questions and support should be directed to Prometheuz at [email protected].

Partner pharmacies are subject to change. Prometheuz reserves the right to add, remove, or modify pharmacy partnerships at any time to best serve patient needs and maintain compliance with applicable regulations.
10. State Coverage & Service Availability
Prometheuz currently offers services in all 50 states plus Washington D.C. Some services may not be available in all 50 states or Washington D.C. Service availability is subject to change.
Certain medications have state-specific restrictions. For example, scheduled medications such as testosterone may only be available in select states, while alternative therapies such as enclomiphene may be available more broadly. Your eligibility for specific treatments will be determined during your clinical consultation based on your state of residence, medical history, and clinical evaluation.
Clinical services are provided by independently licensed healthcare providers through our partner, OpenLoop Health. OpenLoop provides clinicians licensed in all 50 states, healthcare professionals, and non-clinical patient care coordinators as support staff. The opportunity to contact a clinician or healthcare professional to ask questions and receive information is made available at all points in the process.
